CURRIE, J., delivered the following dissenting opinion.
In this appeal from a judgment for the State Highway Commissioner entered by the Baltimore City Court, the sole question is whether the court erred in its determination that the appellants had not carried their burden of showing that any damage to their property caused by the relocation of the highway had been done maliciously or wantonly.
The portion of the subdivision which is here involved is located between the old right of way of the Baltimore & Ohio Railroad and a new right of way in which is located Route 41-A, a State highway. At the time of the hearing below, construction of the new highway had been completed, the new highway being about 50 feet in width and the old railroad right of way being now about 15 feet in width. When the highway was being built, the appellants complained to the State Highway Commissioner that the proposed new highway would destroy their right of access to the railroad, and that the State would be required to pay them damages for the taking of their property. At the hearing before Judge Barnes, an employee of the State Highway Department who had charge of the construction of the new highway testified that the new highway was constructed in accordance with plans prepared by a professional engineer.
