Instead, the court concluded that Krupnick was distinguishable because, while the defendant in that case was indicted on both charges at the same time, the defendant here had a greater burden of proof under a separate double jeopardy statute, namely, the one that would have applied if appellant had appealed his conviction of child abuse, and the one that would have applied if appellant had filed a petition for leave to appeal in this Court, and the State had filed a cross-appeal.
