We are against the appeal for the reversion of the enforcement notice and feel that the enforcement notice to remove the building and restore the site to its former condition, is fair.  
 
The appellant has appealed against the enforcement notice on the grounds that planning permission should be granted for a “barn” However, the building in question is not constructed as a barn. The aluminium sheet frame is not in keeping with an agricultural building, or the surrounding area within the Green Belt. The development encroaches into the open undeveloped countryside, detriment to the rural character of the area contrary to Local Planning Policies.
The original planning permission was for a building for agricultural use, yet the way in which the building has been constructed renders it unsuitable for this purpose. The building has been built in three sections. One is being used as a bedroom and another as a living area complete with sofas etc. There is also a visible sink, which presumably relies on a rainwater feed, as there is no mains water connection to the land and no foul sewerage. It appears as if water from this area is simply discharged to the land, which eventually will end up in Beambrook. The building is clearly being used for domestic purposes with children’s toys and a BBQ visible form the public footpath. Planning permission was refused on the grounds of traffic issues and inappropriate development of Green Belt land. To the best of our knowledge none of these situations have changed. 
There is concern that if the enforcement notice is withdrawn on appeal, that further development of this Green Belt land will occur. There are now multiple plots being sold at Berry Farm. many of which are not of a sufficient size for an agricultural enterprise. This is an identical situation to that encountered at Mudds Bank, Stockenchurch on a piece of Green Belt land, also ironically called Berry Farm, with the same agent dealing with planning applications.  Please refer to the Berry Farm planning applications at Mudds Bank, Stokenchurch for more information.
Berry Farm is situated off a narrow rural road. There have already been issues with the increased traffic entering and exciting onto the rural road and blockages caused by lorry movements into and out of the site.
We strongly suggest that before a decision is made, a site visit is undertaken to review the damaging effect this and other developments at Berry Farm are having on the Green Belt land and open undeveloped countryside.
