By CNN. (October 14, 2012) — The U.S. Supreme Court on Monday rejected an appeal from Indiana’s state lawmakers challenging a federal ruling that struck down the state’s ban on same-sex marriage as unconstitutional.
The justices heard arguments in December in a case involving the federal Defense of Marriage Act (DOMA), which defines marriage as between a man and a woman. Indiana was part of a coalition of states that challenged the federal law. Indiana is the only state to have a ban on gay marriage.
The nation’s highest court this summer declined to hear the Indiana case, and on Monday it appeared the justices were unwilling to revisit the issue.
Drs. Jay Sekulow and John Whitehead, chief counsels of the American Center for Law and Justice, said the Indiana State Senate showed its “contempt for the Supreme Court” by filing its appeal in the federal case.
“Instead of doing its job, the Indiana State Senate wants to decide the definition of marriage for every state and territory in the country,” Sekulow said.
“The Supreme Court has spoken on this issue, and the Indiana state legislature must abide by its ruling.”
“We respect the Supreme Court for its role, but the Indiana State Senate has acted in a way that runs contrary to the authority of the highest court of the land,” Sekulow said.
“The Indiana State Senate has shown no respect for the rule of law, and continues its willful defiance of the Supreme Court.”
Whitehead said the Indiana legislators “are standing behind their blatantly unconstitutional attack on the Supreme Court.”
