The Supreme Court on Tuesday turned down a plea from a Congress MP, Sadhvi Niranjan Jyoti to it to find out whether a woman influenced by the Osho movement developed the mental block of a sex assault survivor.
Defending himself in court, Ravi Shankar Prasad, the Minister of Law and Justice said that a judge would not take judicial notice of whether a woman had developed an idea in her mind about what she had been through.
The plea was filed by the woman who had been accused of sexually assaulting him in July 2014, when he was the Railway Minister.
“We had argued that the Supreme Court should take judicial notice of whether such women had either been exposed to direct or indirect influence by Osho movement,” a bench comprising Chief Justice Dipak Misra and justices A M Khanwilkar and D Y Chandrachud said.
“We also submit that the Supreme Court should examine the facts on the ground and therefore, we do not think that judicial notice will be the appropriate route for deciding the issue,” it said.
