The investigation began in February 2008, following a complaint filed by the girls' father, who found photographs of his daughters on the .
His sister reported the matter to the police, who began investigations. The father, who is from Bologna, had already seen Irina naked, but had not yet seen Daphne, as she had been at her friend's house.
A television journalist, having seen the video, provided information to Italian police.
Suspects
The YVM Operator, a 24-year-old man from Bologna, was arrested on February 3, 2008.
In court, he claimed that the photos were taken on his own computer and that he had shared the photos on the Internet, but not over the Internet. His lawyer, however, argued that the videos were made while the defendant was at his place of residence, as well as on his mobile phone. The owner of the mobile phone, which was seized by the police, gave the phone to the defendant, when he was told that the police had placed it in his bag. The defendant does not know the password of the phone. In addition, the owner also reported to the police that the defendant used to send pictures of young girls to his cellphone, which were also on his computer.
Furthermore, the defendant's lawyer argued that the defendant was not alone in his house when these videos were recorded, because his brother was also in the house at that time. The evidence that was to be used against the defendant did not support the defendant's claims, however, as it showed the presence of the defendant alone in his home.
Police searched his computer and found images and videos of the girls on it. The video files were encrypted, and the defendant claimed that he had removed the files from the computer, but did not give the exact date or the exact time of the removal.
Police also found a pair of pajamas on the defendant, which were similar to the pajamas Daphne had on at the time of her first video.
Aftermath
Daphne, Irina and their parents were highly critical of the investigation conducted by Italian police, and of the evidence that they seized.
