Licensing
Licensing, or licensing, is the distribution of rights in products.  Some products come with their rights distributed along with the product itself; others require the purchaser to obtain a license to use the product or software. The term "license" also may be used in a non-business sense, to refer to laws which prohibit some or all uses of a piece of property.
Theories of licensing
John Locke's idea of property would protect a person from a permanent right in his property. Locke argued that each person should be able to use and benefit from his property by putting it to a use as the other individual decided. 
Herman and Kate Miller's theory of software licences claims that licensing allows individuals to exercise these rights. The need for licenses can be seen as a way to maximize the potential benefit and minimize the loss for each person.
Defining the licensed rights
Licensing arrangements often involve other people, who may also require their own licenses, which means that the products must be exchanged between them.
This can be done using a formal contract, or by sending (or referring to) a model or a template.
A formal contract may be used to define the rights in a product, such as a licence agreement between an employer and an employee. There are different types of licences, such as a software licence and an intellectual property licence.
The license itself must be defined within the terms of the contract. For example, this can be in a form of an appendix, or it may be placed between the contract and a separate document, or it can be included in a separate document.
License types
The most common type of software license is the permissive license, which allows for the user of a program to study the source code of the program in order to understand and modify the program as desired. The user may make as many copies of the program as he desires, sell the program to others, and even pass the program on to others.
In contrast, a non-permissive license usually allows the user to make only one copy of the program and to distribute it to others.  In some cases, a computer user may be forbidden from studying or changing the source code, even if a non-permissive licence is used.
