Labour and Tory MPs yesterday voted to block a new law that could prevent them breaking Commons rules by constantly returning to their constituencies.
MPs last night unanimously agreed to “soften” the House of Commons Disqualification Act by adding in a clause that allows them to vote in by-elections if they are likely to be held in the future.
The amendment will ensure MPs who become ineligible to stand for election on a date that falls during a period they are expected to be campaigning in a general election will not be stripped of their right to vote.
So an MP who will stand down from Parliament after the general election could vote in a by-election if one was about to be held and still be eligible to vote in the general election – despite his or her seat being declared vacant.
This means MPs could expect to do all their campaigning for the general election and then stand down as their MP at a by-election – potentially win it and remain in Parliament – yet vote in the general election and still be eligible to stand for another office.
It is an offence for an MP to try to vote in two elections and if an MP is found to have deliberately tried to cheat in a by-election and deliberately voted for another candidate, they could be expelled from the House of Commons.
Now MPs on both sides of the Commons have voted unanimously to soften that offence so the MP in question could technically vote in a by-election and retain their right to stand in the general election.
The All Parliamentary Party’s Common Interests Clause Committee heard the proposed bill from the Government last year and has now reported back.
Labour MP Chuka Umunna and Conservative Louise Mensch, a former barrister, have tabled the amendment which has the support of all MPs.
It was not considered by a vote by the House of Commons. But it will go to the Commons next week, after MPs in private voted last night.
